DPMA Trademark Opposition
Opposition proceedings before the DPMA allow owners of certain earlier rights to challenge a later German trademark registration. The legal comparison and procedural deadlines require careful preparation.
Back to Trademark Law.
Earlier rights and the challenged mark
The opposition should identify the earlier right relied on and the grounds on which the later registration is challenged. The comparison normally focuses on the marks and the goods or services covered.
Evidence and use issues
Depending on the age and status of the earlier mark, proof of genuine use may become relevant. The evidence should be organised around the relevant period, territory, goods or services and actual commercial use.
Defending an opposed trademark
A proprietor facing opposition should assess both the legal merits and practical settlement options, including limitation of goods or services or coexistence discussions where appropriate.
Preparing a trademark-law review
For an efficient first assessment, it is useful to provide the relevant registration extracts or application numbers, the sign as actually used, the goods or services concerned, key correspondence and a short chronology. In infringement matters, screenshots, packaging, invoices or marketplace listings can help establish how and when the sign was used. In filing matters, planned markets and the intended goods and services are particularly important.
Opposition deadlines and evidentiary requirements depend on the specific registration and procedural stage.
