Design Registration in Germany and the EU
A design application protects the visual appearance represented in the filing. Good preparation therefore focuses on the product, views, variants, owner and territorial strategy.
Back to Design Law.
German or EU design
A German registered design is filed with the DPMA; EU-wide protection can be sought through the EUIPO. The choice depends on markets, budget, portfolio plans and the commercial value of broader territorial coverage.
Representations matter
The images or other permitted representations define what is placed on the register. Background, perspective, omitted features and multiple variants should be handled consistently with the intended protection.
Novelty and disclosure
Public disclosure before filing can affect protection. The timing of launches, catalogues, trade fairs, crowdfunding or social-media posts should be considered before an application strategy is fixed.
Preparing a design-law review
For design matters, useful documents include registration numbers, the official representations, earlier design material, product photographs or samples, launch dates and sales listings. In infringement or imitation disputes, a side-by-side record of the protected design and challenged product, together with market and chronology evidence, can support a focused initial assessment.
Registrability and scope depend on the submitted representations, prior designs and disclosure history.
