HOMETrademark Lawyer in Düsseldorf, GermanyTrademark Search and Clearance

Trademark Search and Clearance

A trademark search helps assess whether a proposed brand may conflict with earlier rights before money is invested in filing, packaging, advertising or market launch.

What a clearance search should address

An exact-name search is only a starting point. Depending on the sign, the assessment may need to consider phonetic, visual and conceptual similarity, the relevant goods or services and the distinctiveness of earlier marks.

Why registration-office searches are not enough

The German registration process does not automatically clear the applicant against all earlier third-party rights. Earlier owners may oppose or later enforce their rights, so clearance is a separate risk-management step.

Using the result commercially

Search findings should be translated into a practical decision: proceed, narrow the specification, modify the sign, seek consent or choose a different brand. The legal risk and the commercial cost of a later rebrand should be considered together.

Preparing a trademark-law review

For an efficient first assessment, it is useful to provide the relevant registration extracts or application numbers, the sign as actually used, the goods or services concerned, key correspondence and a short chronology. In infringement matters, screenshots, packaging, invoices or marketplace listings can help establish how and when the sign was used. In filing matters, planned markets and the intended goods and services are particularly important.
